Privacy Policy on Complaint Handling

In order to comply with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council (hereinafter referred to as “Regulation”), Dynoteq Kereskedelmi és Szolgáltató Korlátolt Felelősségű Társaság (registered office: H-2225 Üllő, Hatháza utca 14.; company registration number: 13-09-119626; hereinafter referred to as “Dynoteq Kft.”) hereby informs you regarding the processing of personal data during complaint handling.

  1. The Data Controller and the Data Protection Officer

Dynoteq Kereskedelmi és Szolgáltató Korlátolt Felelősségű Társaság (registered office: H-2225 Üllő, Hatháza utca 14.; company registration number: 13-09-119626) is the controller authorised to process the name and e-mail address you provided when submitting a complaint.

Dynoteq Kft. has not appointed a Data Protection Officer.

  1. The Purpose and Legal Basis of Data Processing

The purpose of the data processing is to investigate your complaint. The legal basis for the data processing is Dynoteq Kft.’s compliance with a legal obligation (pursuant to Paragraph c) of Subsection (1) of Section 6 of the Regulation and Subsection (5) of Section 17/A of Act CLV of 1997 on Consumer Protection).

  1. Recipients of Personal Data

Your name and e-mail address provided in connection with your complaint may be accessed by persons representing or acting on behalf of, or employed by, RamNode LLC (registered office: 2870
Peachtree Rd NW #915-5414, 30305 Atlanta GA, USA; company registration number: 12053812), which provides the IT infrastructure for the website.

Dynoteq Kft. will not disclose your e-mail address provided for complaint handling to any other person.

  1. Categories of personal data

In connection with complaint handling, Dynoteq Kft. processes your name, e-mail address, and any other personal data required pursuant to Subsection (5) of Section 17/A of Act CLV of 1997 on Consumer Protection.

  1. Duration of Data Processing

Dynoteq Kft. will process the personal data you provide for a period of three years.

  1. Rights of the Data Subject

Dynoteq Kft. shall fulfil a data subject’s request to exercise their rights within a maximum of one month from receipt. The day the request is received is not included in the time limit.

Considering the complexity of the request and the number of requests, Dynoteq Kft. may extend this period by an additional two months if necessary. Specifying the reasons for the delay, Dynoteq Kft. shall inform you of any extension of the deadline within one month from the receipt of the request.

To exercise your rights regarding data processing, you may contact Dynoteq Kft. at the e-mail address [email protected].

You may exercise the following rights in relation to the processing of your personal data:

  • Right to access

You may request information from Dynoteq Kft. as to whether Dynoteq Kft. processes your personal data.

If Dynoteq Kft. processes your personal data, you are entitled to know the following:

  • which personal data are processed by Dynoteq Kft., on what legal basis, for what purpose, and for how long;
  • to whom, when, and under which legal basis Dynoteq Kft. has granted access to your personal data or to whom it has transferred your personal data;
  • the source of your personal data;
  • whether Dynoteq Kft. applies any automated decision-making, including profiling, and the logic behind it.

Upon request, Dynoteq Kft. will provide you with a copy of the personal data being processed free of charge for the first time; for any subsequent requests, it may charge a reasonable fee based on administrative costs.

To ensure compliance with data security requirements and to protect your rights, Dynoteq Kft. must verify that you are the data subject; accordingly, the provision of information, access to personal data, and the issuance of copies are all subject to verifying the identity of the data subject.

  • Right to rectification

You have the right to request that Dynoteq Kft. correct any inaccurate personal data relating to you or complete any incomplete personal data relating to you without undue delay.

If you can credibly demonstrate the accuracy of the corrected data, Dynoteq Kft. will fulfil the request within one month and notify you via the contact details you provided.

  • Right to erasure

Upon your request, Dynoteq Kft. will erase your personal data without undue delay, except where the processing is necessary for the establishment, exercise, or defence of legal claims.

In other cases, Dynoteq Kft. will erase your personal data without undue delay if (i) Dynoteq Kft. no longer needs the personal data for the purpose for which they were collected or processed; (ii) you
object to the processing of your personal data for reasons related to your particular situation, and there is no overriding legitimate reason for the processing; (iii) your personal data have been processed unlawfully; or (iv) Dynoteq Kft. is required to erase the personal data to comply with a legal obligation.

  • Right to restriction of processing

You may request that Dynoteq Kft. restrict the processing of your personal data in the following cases:

  • you contest the accuracy of your personal data (in which case Dynoteq Kft. will restrict processing for the period necessary to verify the accuracy of the data);
  • the data processing is unlawful, you oppose the erasure of your personal data, and instead request the restriction of its use;
  • Dynoteq Kft. no longer needs the personal data for data processing; however, you require the restriction for the establishment, exercise, or defence of legal claims; or
  • you have objected to the processing (in which case the restriction applies for the period necessary to determine whether the legitimate grounds of Dynoteq Kft. override your reasons).

In the case of restricted data processing, except for storing the data, Dynoteq Kft. may only process your personal data with your consent, or for the establishment, exercise, or defence of legal claims, or to protect the rights of another person.

  • Right to object to the processing of personal data

You may object to the processing of your personal data on grounds relating to your particular situation if the data processing is necessary for the legitimate interests pursued by Dynoteq Kft. or a third party.

  • Right to data portability

In connection with data processing based on the performance of a contract or your consent, you may request that Dynoteq Kft. transfer your personal data, which are processed automatically (not in paper format) to you or to another Data Controller you designate.

  1. Remedies in Case of a Breach

If you believe that Dynoteq Kft. has breached your rights in the processing of personal data,

  • you may contact Dynoteq Kft. at the e-mail address [email protected], or

  • you have the right to apply to a court to protect your data, which will handle the case with priority. In the latter case, you may freely choose whether to lodge your claim with the regional court having jurisdiction according to your place of residence (permanent address), your place of stay (temporary address), or the registered office of Dynoteq Kft.
