Privacy Policy on the Processing of Personal Data Recorded by the Camera System

In order to comply with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council (hereinafter referred to as “Regulation”), Dynoteq Kereskedelmi és Szolgáltató Korlátolt Felelősségű Társaság (registered office: H-2225 Üllő, Hatháza utca 14., company registration number: 13-09-119626; hereinafter referred to as the “Company”) hereby informs you on the processing of your personal data recorded by the camera system.

  1. The Data Controller and the Data Protection Officer

With regard to personal data, the Data Controller is Dynoteq Kereskedelmi és Szolgáltató Korlátolt Felelősségű Társaság (registered office: H-2225 Üllő, Hatháza utca 14.; company registration number: 13-09-119626).

The Company has not appointed a Data Protection Officer.

  1. The Purpose and Legal Basis of Data Processing

The Company processes your visual images recorded by the camera system for the following purposes:

  • protection of intellectual property used by the Company,
  • protection of trade secrets,
  • protection of movable property,
  • accident prevention,
  • detection and documentation of unauthorised access.

The legal basis for data processing is the legitimate interest of the Company (Paragraph f) of Subsection (1) of Section 6 of the Regulation). The legitimate interests of the Company are as follows:

  • protection of intellectual property used by the Company,
  • protection of the Company’s trade secrets,
  • protection of movable property,
  • prevention of workplace accidents occurring during the use of machinery at the Company,
  • taking legal action against persons who enter the Company’s premises without authorisation and using the recordings as evidence for such legal actions,
  • investigation of the circumstances of unlawful acts occurring on the Company’s premises and using the recordings pertaining to such unlawful acts as evidence.
  • Persons authorised to access personal data and review recordings

The Company does not continuously monitor the camera recordings. The Managing Director, the IT Officer, and the Plant Manager of the Company are authorised to view and review the camera recordings.

The recordings may be reviewed in the following cases:

  • any suspected infringement or unauthorised use of intellectual property used by the Company,
  • suspected leakage or theft of the Company’s trade secrets,
  • accidents involving an employee of the Company,
  • malfunction of machinery owned by the Company,
  • investigation of the circumstances of damage to the movable property of the Company, and where there is a suspicion that preparatory acts for a crime against the Company’s assets are being carried out,
  • preparation of legal actions against persons who enter the Company’s premises without authorisation,
  • suspicion of unlawful acts on the Company’s premises and investigation of the circumstances of unlawful acts occurring on the Company’s premises,
  • investigation of the circumstances of unlawful acts occurring on the Company’s premises.
  • Recipients of Personal Data

The Company does not make your visual images recorded by the camera system accessible to any third party.

  1. Duration of Data Processing

The Company processes the video recordings for 4 (four) weeks.

  1. Rights of the Data Subject

To exercise your rights regarding data processing, you may contact the Company at the e-mail address [email protected].

The Company shall fulfil a data subject’s request to exercise their rights within a maximum of one month from receipt. The day the request is received is not included in the time limit.

Taking into account the complexity of the request and the number of requests, the Company may extend this period by an additional two months if necessary. Specifying the reasons for the delay, the Company shall inform you of any extension of the deadline within one month from the receipt of the request.

You may exercise the following data subject rights at the Company:

  • Right to access

You may request information from the Company as to whether the Company processes your personal data.

When submitting a request, please indicate the location where the recording was made and the time interval of the recording to the nearest 30 minutes.

If your request includes obtaining a copy, the Company shall provide you with a copy of the processed personal data in such a way that other individuals appearing in the camera recording are not identifiable in the copy.

  • Right to rectification

You have the right to request that the Company correct any inaccurate personal data relating to you or complete any incomplete personal data relating to you without undue delay.

Your right to rectification does not extend to having the Company modify the camera recording itself; however, it does include the right to have the Company correct the record concerning the review or provision of the camera recording if it contains inaccurate or incomplete personal data.

  • Right to erasure and right to object

You may request the erasure of the video recording or object to its processing.

The Company shall not erase the camera recording if the balance of interests test conducted regarding the camera system demonstrates that the Company has a legitimate interest that takes precedence over the rights of the data subject, and, in such cases, the Company shall inform you of the results of the balance of interests test, furthermore, the Company shall not erase the camera recording if the processing of personal data is necessary for compliance with a legal obligation
applicable to the Company, or for the establishment, exercise, or defence of legal claims.

The Company shall erase the camera recording if you object to the data processing and the Company has no overriding legitimate grounds for the data processing, or if the Company is obliged to erase
the personal data to comply with a legal obligation.

  • Right to restriction of processing

You may request the restriction of the processing of personal data if you dispute the accuracy of the personal data, if the processing is unlawful and you oppose the erasure of the personal data, if the
Company does not need the personal data for the purposes of data processing, however, you require the restriction of personal data for the establishment, exercise, or defence of legal claims, or if you object to the data processing for reasons related to your particular situation.

  1. Remedies in Case of a Breach

If you believe that the Company has breached your rights in the processing of personal data,

  • you may contact the Company at the e-mail address [email protected], or

  • you have the right to apply to a court to protect your data, which will handle the case with
    priority. In the latter case, you may freely choose whether to lodge your claim with the
    regional court having jurisdiction according to your place of residence (permanent address),
    your place of stay (temporary address), or the Company’s registered office.
